All to often a client will come to our offices seeking advice on how to "get out" of a Commercial Lease because one side did not read the Commercial Lease before signing. DO NOT MAKE THIS MISTAKE! New York Commercial Leases are complex! Do not take my word for it, look at any New York Commercial Lease. These documents are often 50 to 150 pages long filled with dull text. What you need to be concerned with is that every word of that lease makes sense and is in accord with your needs. Typical issues that arise for parties who did not read the Commercial Lease are as follows: They get hit with a real estate tax bill which they did not expect--usually several thousands of dollars a month; No renovations are permitted unless agreed to by the Landlord (thought your sign would not be a problem in front of the building?); If the Tenant vacates the property early, that Tenant is still responsible for all the rent for the entire term of the lease even though the property is either vacant or being used by a new tenant, etc.
